Terrorists are not protected by the Constitution, and the Executive reserves the right to identify those who are captured on foreign battlefields, fight for no formal army, and pose a threat to the Republic as enemy combatants. They may detain those enemy combatants until the end of the hostilities. It is completely legal.
Yes, of course they must be tried; no argument there; but we are not required to try them until the end of the conflict. The Bush Administration set the military tribunals in motion, and were widely condemned by the international community even though they were abiding by the law. Again, the Constitution does not apply here; Foreigners captured on foreign soil, and held outside the mainland? Come on.
the US Supreme Court has recently ruled that they do in fact have jurisdiction in defacto US territory (Gitmo). If they didn’t, it’d still go against the spirit of the US constitution. And no, Bush wasn’t abiding by the law, he was just committing his crimes in Gitmo since until recent case law the jurisdiction of the courts there was ambiguous. per the Geneva convention combatants captured within the nation to which they are a national are protected.
